Deciding to end any relationship is tough, going through the legalities of it makes it even harder. When your spouse is served with divorce papers, he or she may immediately hire a lawyer to contest part of them. If you have acquired real estate or there is considerable money involved, you can be sure there is going to be debate over who is entitled to what. Children can pose another area of debate. Not only will the divorce need to decide who has primary physical and legal custody, there will also be visitation rights and child support to consider. The decision needs to be fair to the children first, whether you like it or not.

Once everything has been agreed to, both you and your spouse must follow through on any instructions from the court regarding the splitting of property, taking a divorced parenting class or breaking an IRA. At that point, the judge will sign the divorce decree and you will be single again. Not following the orders could result in you being charged with contempt of court, which will delay the whole process and could put you in jail. Be sure to keep up with any child support or alimony payments or you will be back in court again.
